Agreement to Terms

By accessing and using TrackIT ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

Use License

Permission is granted to temporarily use TrackIT for personal and commercial monitoring purposes. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modify or copy the materials
• Use the materials for any commercial purpose or for any public display
• Attempt to reverse engineer any software contained on TrackIT
• Remove any copyright or other proprietary notations from the materials

Service Description

TrackIT provides server and website monitoring services including:

• Real-time server performance monitoring
• Website uptime and response time monitoring
• Alert notifications via email, SMS, and webhooks
• Historical data reporting and analytics
• SSL certificate monitoring

User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for:

• Safeguarding the password and all activities under your account
• Notifying us immediately of any unauthorized use of your account
• Ensuring your account information remains accurate and up-to-date

Acceptable Use Policy

You agree not to use TrackIT to:

• Violate any laws or regulations
• Infringe on the rights of others
• Distribute malware or engage in malicious activities
• Attempt to gain unauthorized access to our systems
• Use the service for illegal or unauthorized purposes
• Interfere with or disrupt the service

Payment Terms

For paid services:

• Fees are billed in advance on a monthly or annual basis
• All fees are non-refundable unless otherwise stated
• We may change our fees with 30 days' notice
• Payment is due immediately upon invoice
• Failure to pay may result in service suspension

Service Availability

We strive to maintain high service availability but cannot guarantee:

• 100% uptime of our monitoring services
• Uninterrupted access to our platform
• Error-free operation at all times

We will make reasonable efforts to notify users of planned maintenance and outages.

Data and Privacy

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices.

You retain ownership of your data. We may use aggregated, anonymized data to improve our services.

Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of TrackIT and its licensors. The Service is protected by copyright, trademark, and other laws.

Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will cease immediately.

Disclaimer

The information on this service is provided on an "as is" basis. To the fullest extent permitted by law, TrackIT excludes all representations, warranties, conditions and terms relating to our service and the use of this service.

Limitation of Liability

In no event shall TrackIT, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

Governing Law

These Terms shall be interpreted and governed by the laws of the State of California, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.
